The purpose of the Notice on the website is to inform you that you may be a member of a class action lawsuit. Because your rights may be affected in the lawsuit it is extremely important that you read the Notice carefully. The Notice summarizes the case and your rights.
If you received an email or postcard Notice about this case, it is because the call records produced in the case indicate you may have received one or more of the prerecorded calls at issue in the case and may be member of the Class.
In a class action, one or more people called Class Representatives (here, Plaintiff George Moore) sue on behalf of people who have similar claims. This group is called a class and the persons included are called class members. One court resolves the issues for all of the class members, except for those who exclude themselves from the class.
Here, Plaintiff claims Club Exploria, LLC violated the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227, et seq., by hiring vendors who telemarketed its Summer Bay Resort timeshares through prerecorded phone calls made to cellular telephone numbers without the prior express written consent of the called party. The TCPA provides $500 per violative call. The Court has certified the case as a class action. The Honorable Edmond E. Chang is presiding over this action.
All persons in the United States subscribing to a cellular telephone number that received a prerecorded soundboard call promoting Club Exploria’s Summer Bay Resort between March 1, 2018, and August 15, 2019, where the soundboard operator initiated a transfer of the call to Club Exploria.
The Court has appointed the law firms of Keogh Law, Ltd. and Paronich Law, P.C. as Class Counsel to represent you and the other persons in the Class. You will not be personally charged by these lawyers.
Unless you exclude yourself, you will remain a member of the Class. By staying in the Class, the Court will resolve your TCPA claim. If you do not exclude yourself and the Class wins, you may receive a payment. If you do not exclude yourself and the Class loses, you will receive nothing. Either way, you will be bound by the judgment and will lose your right to file your own lawsuit against Defendant regarding the matter at issue.
If you exclude yourself, you will not receive any money recovered in the class action, but you will have the right to bring your own case to sue Defendant over the claims raised in this case. Also, the time you have in which to file your own lawsuit (called the “statute of limitations”) will begin to run again. You will have the same amount of time to file the suit that you had when this case was filed.
